Terms and Conditions

Real estate services on RocketListings.ca are provided by Robin Hood Realty Limited, Brokerage (RECO registration #5048695), 6 Steven Ave, Toronto, ON M6B 3L8, call or text 647-360-9060 (the "Brokerage", "we", "our", or "us"). RocketListings.ca (the "Website") is the online service through which the Brokerage offers its mere posting service. These Terms and Conditions ("Terms") govern your use of the Website and our services. You must read and accept these Terms and the Mere Posting (Limited Service) Representation Agreement (the "Agreement") before you pay for a listing.

1. Service and Representation

The Brokerage lists your property for sale or lease on the MLS® System and REALTOR.ca on a limited-service ("mere posting") basis. When you purchase a listing plan you become a client of the Brokerage under a representation agreement, as permitted by the Trust in Real Estate Services Act, 2002 (TRESA). The Brokerage's services are limited to those set out in the Agreement: the Brokerage does not show your property, advise on price, or negotiate offers for you. You deal directly with buyers, tenants and their brokerages. If the Agreement and these Terms conflict, the Agreement governs.

2. User Eligibility

  • Be at least 18 years old;
  • Be an owner of the property, or be authorized by all owners, to list it;
  • Provide accurate and complete information; and
  • Comply with all applicable laws, board rules and regulations.

3. Accounts

  • You are responsible for maintaining the confidentiality of login credentials;
  • You are responsible for all activities that occur under your account;
  • You must notify us immediately of any unauthorized use; and
  • You must keep account details accurate and up to date.

4. Property Listings

  • Provide accurate and truthful property information;
  • Only submit photos and content you have the right to use;
  • Comply with all applicable real estate laws and board rules;
  • Keep your listing information accurate; and
  • Tell us within 2 business days when your property is sold or leased.

5. Photo and File Upload Limits

  • Photos: up to 40 photos per listing, JPEG or PNG format, each under 5 MB. Photos are compressed automatically when uploaded.
  • Documents (ownership and identity verification, agreements of purchase and sale or leases): JPEG, PNG or PDF, each under 5 MB (agreements up to 10 MB).

Files that exceed these limits may be sent by email or a secure link (for example Dropbox or Google Drive). You are responsible for making sure your files meet these requirements.

6. Start of Service

Service begins when you complete your purchase and submit (or attempt to submit) property details and media for processing. We may contact you for clarifications or missing items. Publication on the MLS® System is subject to board rules and compliance review.

7. Fees and Payment

You pay the Brokerage a flat fee for the plan you choose, plus HST, when you purchase. No commission is payable to the Brokerage when your property is sold or leased. Any commission you offer to a buyer's or tenant's brokerage is set by you and paid by you directly, as described in the Agreement.

8. Term, Cancellation and Refunds

  • Each plan has a fixed term shown before payment and on page 1 of your Agreement: 2, 3 or 6 months, or 12 months for the MAX plan. The Monthly Subscription renews each month until you cancel.
  • You may cancel your listing or subscription at any time from your dashboard or by email. For the Monthly Subscription, no further charges are made after cancellation.
  • Because our services are digital, fees are non-refundable once a listing has been submitted for processing, unless we are unable to provide the service through no fault of yours.
  • Holdover and other obligations that continue after the Agreement ends are set out in the Agreement.

9. Customer Responsibilities

  • Provide complete and accurate information and documents in usable formats;
  • Respond promptly to compliance or clarification requests;
  • Review drafts and proofs in a timely manner; and
  • Understand that failure to provide required information does not constitute non-delivery of services.

10. Prohibited Activities

  • Use of the services for unlawful or unauthorized purposes;
  • Submission of false, misleading, or fraudulent information;
  • Attempted unauthorized access to systems or data;
  • Interference with or disruption of the services; and
  • Harassment, abuse, or harm to others.

11. Security and Data Handling

We use commercially reasonable safeguards to protect information sent through the Website. No method of transmission or storage is 100% secure. Please review our Privacy Policy for how we collect, use and keep information.

12. Disclaimers

The Website is provided on an "as is" and "as available" basis. We do not guarantee: (a) the accuracy of property information you provide; (b) the sale or lease of your property; (c) continuous availability of the Website; or (d) compatibility with all devices or browsers. Nothing in these Terms limits the Brokerage's obligations under TRESA or the Agreement.

13. Uptime and Maintenance

We may perform maintenance or updates that temporarily affect availability. Board outages, third-party platform issues and internet disruptions are outside our control.

14. Chargebacks and Disputes

Please contact us first to resolve any issue before starting a chargeback. Chargebacks for services already begun or delivered may be contested using order records, communications and publication proofs. Concerns about a registrant may also be raised with the Real Estate Council of Ontario (RECO).

15. Intellectual Property

The Website contains intellectual property owned by us or our licensors. You may not copy, reproduce, distribute or create derivative works without express written consent.

16. Indemnification

You agree to indemnify and hold the Brokerage and its employees harmless from claims, damages or expenses arising from information or content you provide or your violation of these Terms.

17. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or loss of profits, data or goodwill, arising from your use of the Website.

18. Suspension of Website Access

We may suspend access to the Website for suspected violations of these Terms. Ending your representation agreement is governed by the termination section of the Agreement.

19. Governing Law and Venue

These Terms are governed by the laws of the Province of Ontario, Canada. You agree to the exclusive jurisdiction of the courts located in Ontario.

20. Changes to Terms

We may change these Terms from time to time. Changes are posted on the Website with an updated "Last updated" date. Changes do not alter an Agreement you have already signed unless you agree in writing.

22. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
